Looking for Advise, Information

In Dec.2007, I was informed I had to take a random drug screen, the first taken Dec. 06,2007, came back negative, diluted. Four days later, I returned and took another drug test, which came back positive for methamphamines. I do not do drugs. I talked to my MRO officer while dispatched in Florida, haveing just getting unloaded in Dover, Fl., I was then dispatched to Ocala, Fl. to pick up another load going to Greenville, SC. My employer, a small flatbed owner-operator located in Thomson, Ga. told me not to worry about any drug test results, I requested pulling into the FL. DOT scales,to take another drug test, but he told me to pick this load up and he would take care of any drug test results, so I went to Ocala, and picked this load up and drove to Thomson, Ga. He told me to be there early Monday morning to deliver this load in Greenville, SC. On monday morning, at around 3:30am, he hands me a form to report to Stepping Stones Recovery, in Augusta, Ga., I went back home, tried to find an attorney, two days later, I went to McDuffie Medical Regional Hospital, and paid for my own Federal Transportation Drug test, got the Negative drug test results, went back to my employer, and quit. In June, 2009, I found out my ex-employer and his mechanic, an ex-con from the Ga. Department of Corrections, who served time for possession of methamphamines, worked together to infect me by mixing an active ingrediant used in meth,with a horse liniment, DMSO 90%, DIMETHYL SULFOXIDE. I have since done research on this liniment and copyed all information. This information I sent to the Federal Motor Carriers Association, in Atlanta, and in Washington, DC. the Department of Transportation in Atlanta, Ga. and in Washington, DC. and to the American Association of Medical Review Officers in Research Triangle Park, NC. I sent an informed letter to my Medical Review Officer in Augusta, Ga. I have since learned the place I took my drug test is NOT certified as a DOT, FMCSA drug test facility, and my MRO officer is not certified. What are my options?? I just want to clear my good name and reputation and go back to work driving an eighteen wheeler. A detailed is available upon request..

I am not sure what you are asking? Did you fail a drug screen? why was the test diluted? They always let you seal the sample with your signature before sending the sample off... was the seal broken? were you terminated? Is this failure on your DAC report? did you attend one of those WORTHLESS SAP programs? and if you did attend one why did you if you were innocent?? I need more info on what you are asking....

I'm asking what are my legal options??? Yes, I failed the second random drug screen, I don't know why the first test came back "diluted" No matter how many seals were on my samples, I was "infected" with DMSO, 90%, available from any vet's office for around $18.00, mixed with an active ingrediant used in methamphamines. From Dec. 05, till Dec. 10,2007, everything I touched was greasy, clear, and had no odor. No, I was not terminated, My right to drive was denied, I was suppose to show up at a SAP program in Augusta, GA. I went to the local hospital and paid for my own drug test, it came back negative, I took a copy of that drug test results to my employer, and I quit. I have not gone to any drug rehab facility, because that to me would be an admission of guilt. I wasn't doing any drugs. I had nothing to worry about. I just found out the place I took my drug tests isn't on the DOT's or the FMCSA's list of certified test sites, my MRO officer is not certified.. I was railroaded by my ex-employer and his mechanic, who I now know served time in prison for possession of methamphamines. Do I have any legal options???

Ok first off let me tell you that I am here to help in any way I can as always.... BUT I am not an attorney and I can only offer you advice. First off, If this company is giving you a bad reference and they DO NOT submit reports to DAC (being as small companies usually do not submit to DAC ) I would just leave them off my employment history, depending on how ever long you worked for them. Now if they do submit to DAC and reported that failure, but your sample was sent to a screening facility that was not certified, I would say of course you have legal recourse but hiring an attorney will be costly. The other way to fix this situation is to post what happened to you under DAC FIX topic and see what there input is on this subject. I am not affiliated with DAC FIX, they are an advertiser on my site but I know that they have been proven to get results at a minimal cost compared to an attorney, or I wouldn't have allowed them on my site.
