Failed Drug Tests/ Refusals

Postby dacfix on Wed Dec 02, 2009 3:47 pm

We will dispute failed drug tests under certain circumstances. If you have a prescription, of course we will dispute it, if you were not alloted enough time under DOT guidelines, we will dispute this as well.

A failed drug test will stay on your DAC report for 3 years, however, if the company lists a company policy violation and/or termination behind the failed drug test, this information will stay on your DAC for 7 years.

Many times drivers call with questions about refusals. If you have already quit and they sent you to take a drug test and you do not go, this is not a refusal since you are no longer an employee of that carrier, we would dispute this. Again, if you are not given a proper amount of time under DOT guidelines to get to the drug testing facility and the carrier has you as a refusal, we will dispute this.

I have had some PMs on this topic so let me explain... If you FAILED a drug screen by doing illegal drugs, OR being at your cousin BOB'S house while they were smoking pot, DAC Fix can not help you get that off and learn from your mistake DONT DO DRUGS IF YOU HAVE A CDL.... NOW if you had a legitimate reason for failing the screen, that is a totally different situation... If you had a prescription for medical Marijuana  ..... then you don't need to be driving a truck!, you need to find a job where your prescriptions do not endanger the public... hope this answered some of your personal messages sent to me...

as always BE SAFE OUT THERE !!!

Thanks for the clarification on this one Kidd!

That is correct, if you have failed a drug test because you did illegal drugs, no we can not help you. This is strictly for drivers who HAVE THEIR OWN prescription from a board certified physician and had a positive drug test due to not listing the prescription on the testing form.

Also, if the carrier tells you they need you to take a drug test and you say no, we can not help you there either. We dispute refusals under certain circumstances: you were told to go take a drug test at 4:50 P.M. and the testing site is 20 miles away and closes at 5:00 P.M. o

For specific questions about if we can or will take on your case, give us a call directly.

Have you spoke with DAC FIX yet? Also why are they saying it wasn't normal body temp? That is pretty cut and dry observation... The bottle has a temp indicator on it, and as soon as you finish filling the cup they read it immediately. That keeps people from using someone else's urine sample in which case I'm not saying you did that, but I have never heard of the temp strips malfunctioning, and did someone actually watch you give the second sample? I need more details, and I'm sure Joni will weigh in on this as well when she reads it.

I'm not sure based on your user name who I am speaking with, however, I can assure you that there is someone in the office from 9am-5pm Central. If our Case Manager is telling you that we are waiting, it is because we are waiting on Hire Right for a response. Please don't hesitate to call us with any questions you have.

I am sure they are doing everything they can to help you, but what I am saying is that there are temp strips on the cups you fill with your urine. As soon as you finish and hand the specimen to the person giving the test, that person immediately records the temp of the specimen which prevents people from using other peoples urine, it is then sealed and you sign the specimen that is to be sent to the testing facility. That is how it is supposed to be done anyway. As for DAC Fix not answering your call, I have never had a problem getting in touch with them when I call during normal business hours, and as you can see they always respond to questions posted to this forum promptly.8)
