DAC is a bare repository of information from all carriers that are members. As long as each carrier has their own interpretation of accident vs incident, nothing will change. Additionally, if a company says a driver has 0 preventable accidents, most employers that follow DOT guidelines will contact each previous employer (three years worth) and requests a written verification and their drug and alcohol information of a driver. A driver may never see these because he does not know to ask for a copy. I believe, with new Federal law changes recently implemented (this past January I think), a driver has a right to receive a copy of his application and all paperwork that is part of that file because it is an official record. He must usually request this copy in writing. This is why many employers will hold on to a copy for 90 days before destroying it. But drivers rarely ask for a copy because they do not know they can. You would be surprised by the amount of information these verifications contain. Many times, they are worse than the DAC information. Of course, many employers will not give it until legal action is taken. But it is a driver's right. The focus should not be on DAC alone.
